Terms of Service (ToS)

This Agreement (the “Agreement”) is made by and between StreamingServers LTD. (“StreamingServers” or “we”) and Customer (also referred to as “you”) and is effective as of the date that you confirm your acceptance by placing your order at https://streamingservers.host/ (the “Website”) or via digital signature. These terms, along with the attached Acceptable Use Policy ("AUP"), shall hereinafter be referred to as the "Agreement" between the two above mentioned parties.

Age

You represent and warrant that you are at least eighteen (18) years of age.

Account Setup

Your account will be set up after the payment is received and you will be notified by email once your account is set up. It is your responsibility to provide us an accurate email address and keep it updated at all times as all account notifications and notices will be sent to this email address.

Service Pricing

You acknowledges that the nature of the service furnished and the initial rates and charges have been communicated to you. The Customer is aware that the StreamingServers may prospectively change the specified rates and charges from time to time. The promotional offer is contingent upon StreamingServers achieving and maintaining its cost of service goals including but not limited to rates charged to company by its suppliers.

Server Space & Bandwidth

Customer may only occupy the allocated disk space, bandwidth, and Mbps speed, as described in the Order Form. Additional fees will be charged for exceeding these resources. If these resources are excessive the point that it is disrupting other accounts holders on the same server, StreamingServers reserves the right to deactivate the service until a resolution is reached.

Payment Terms & Fees

Customer will pay all fees due according to the prices and terms listed in the Order Form(s) and all other fees incurred by the Customer related to the Supplemental Services, Professional Services, reinstatement of service fees and fees for switching or upgrading servers, all in accordance with the current StreamingServers prices and policies.

Invoice Notifications

StreamingServers will send any invoices to the main email account of the owner of the account based on the service terms. StreamingServers cannot guarantee that this email will be received by the client. As an option, we provide the Customer a Billing Control Panel (also referred to as a Client Portal) where the service invoices can be reviewed and paid.

Suspension, Termination & Cancellations

Any payment not received within three (1) days of the invoice due date, StreamingServers reserves the right to suspend the service without any notice. If after fourteen (3) days of not receiving payment confirmation, StreamingServers reserves the right to terminate the service, and consequently remove all existing content (data, emails, files, etc.), without any further notice.

Customers who are not under contract can cancel their account in any billing cycle. Account cancellations must be made at least four (3) days in advance via our Billing Control Panel (Client Portal). StreamingServers is not responsible for additional charges made after cancellation. If a payment is deducted after cancellation, StreamingServers may refund it.

Refunds

StreamingServers does not provide refunds for it's services. All sales are final. We do not refund any part of our billing fees for any unused time except for servers terminated by StreamingServers decision.

Liability

StreamingServers will not be liable for failure or delay in performing its Services if such failure or delay is due to circumstances beyond its reasonable control, such as acts of any governmental body, war, insurrection, sabotage, embargo, fire, flood, strike or other labor disturbance, interruption of or delay in transportation, equipment malfunctioning, unavailability of, interruption or delay in telecommunications or third party services (including DNS propagation), failure of third party software or hardware or inability to obtain raw materials, supplies or power used in or equipment needed for provision of the Services.

StreamingServers will not be liable for damage or interruption of service caused third parties such as dos-attacks, hacking or malware. Customer may be held liable for damages caused to StreamingServers or to third parties as a result of the Customer's usage of the Service.

Indemnity

You shall indemnify and hold StreamingServers, our affiliates and subsidiaries, employees, directors, officers and shareholders of the same harmless from and against all claims, losses or damages (including attorney’s fees and costs) in favor of any agency, person, firm or corporation, arising from or relating to (i) any personal injury or property damage in any way resulting from the acts of you, your End Users, employees or agents; (ii) any violation of Section 10 or any claim by a third party that the content, use and/or publication of information and communications transmitted by you or your End Users using the Services (“Content”) infringes upon the rights of such third party, regardless of the form of action, whether in contract, tort, warranty, or strict liability and whether in respect of copyright infringement or any manner of intellectual property claims, defamation claims, claims of publication of obscene, indecent, offensive, racist, unreasonably violent, threatening, intimidating or harassing material; or (viii) your failure to comply with applicable data breach or data protection legislation.

Governing Law

This Agreement will be governed by and construed and interpreted in accordance with local country laws of our DC facilities.

Amendments

StreamingServers reserves the right to change this Terms of Service at any time, without prior notice. We will take reasonable effort to notify Customer regarding such changes.

Acceptable Use Policy (AUP)

This Acceptable Use Policy specify the restrictions applied to the service you are subscribing from StreamingServers. This policy is created and followed carefully to ensure the protection, integrity, reliability and privacy of StreamingServers as a web hosting provider. StreamingServers has the right to change this policy at any given time, and at the moment of its modification, it is put into effect immediately. You alone are responsible for all actions that occur during your use of AbeloHost’s services, and you agree not to use your services for causes that are prohibited.

Please note that this Acceptable Use Policy is subjected to change and it is Customer’s responsibility to regularly check for modifications. (Customers, users, and visitors are referred collectively as Customer).

Prohibited Content

Certain content is prohibited. You are responsible for any content transmitted, or accessed, using our network. Transmission, storage, or presentation of any information, data or material in violation of any applicable law or regulation is prohibited. You may not use our network to facilitate the violation of any particular law or regulation or this Acceptable Use Policy. The activities listed below are meant to provide you with examples of activities and content that are strictly prohibited by this Acceptable Use Policy and the list is not exhaustive. Use of our network to host content related to or to engage in the following activities is strictly prohibited.

• Child Porn
• Bulk Mailing
• Terrorist Websites.
• Scam/Fraudulent Websites
• Virus / Trojan / Malware Distribution
• Phishing / Financial Scam websites
• Selling illegal substances
• IP Spoofing Attacks / Botnets
• Any type of activity that can lead to the IP being blocked by organizations such as Spamhaus

Content Responsibility

Client is wholly & solely responsible for all of his content and activities on our servers & network. We do promote freedom of speech, so we don’t really censor our clients based on their content and activity. StreamingServers bears no responsibility for the utilization of domains registered with us, as well as the content of any materials posted under sites with these domains or sites hosted on our servers/network.

Privacy Policy

Your privacy is important to StreamingServers, therefore StreamingServers takes great care in handling the personal data of its customers in order to protect customer privacy. We believe you should know what information they collect from you, as well as how that information is used, disclosed, and protected. StreamingServers has created this Privacy Statement to explain their privacy practices and policies. This statement does not cover data hosted, transmitted or processed on infrastructure leased from StreamingServers by its customers. The customer leasing StreamingServers services will be responsible for the personal data processing, acting as a data controller. If at any time StreamingServers has access to personal data stored on infrastructure leased from StreamingServers, StreamingServers shall be the data processor, and any actions performed by StreamingServers in relation to such data shall be solely governed by the agreement concluded between StreamingServers’s customer and StreamingServers.

StreamingServers will not sell or disclose your personal information to unaffiliated third parties without your consent except as otherwise provided in this statement or our General Terms and Conditions of Sale and Services, and Acceptable Use Policy.

Registration and Billing Information

YWe use Registration and Billing Information to identify Users for out internal records. Registration and Billing Information is used throughout our business to provide services to Users, and to market new products and services to them. Information related to payment, such as transaction id's, are only used to ensure we receive payment for services rendered.

How We Use Your Information

We do not sell or rent personal information to others! The information we collect through our Site and Services is primarily used to create new accounts, collect payment for our Services, identify and communicate with current subscribers, or offer troubleshooting or customer support. We may also use personal information for the following reasons:

• To verify your identity when you login to the Site or Service.
• For internal record keeping.
• To complete your online order.
• To administer and improve our Site and Services.
• To respond to your requests or inquiries and for other customer service purposes.

Data Security

StreamingServers uses technical security measures to prevent the loss, misuse, alternation or unauthorized disclosure of information under our control. Black Host uses security measures, including and not limited to: physical, electronic and managerial procedures to safeguard and secure the information we collect online. All sensitive information is collected on a secure server. When we ask customers or users to provide financial information that data is protected using Secure Sockets Layer ("SSL") technology.
